How Do I Pay an Attorney to Handle a Personal Injury Claim?

Even if you don’t have to miss work, you are likely to have other expenses like co-pays and deductibles for medical treatment, expenses relating to your car repairs or a rental while the case is investigated, payments for your prescriptions, and other expenses.

Most personal injury lawyers will take your case on a contingency fee basis. This means that they take a percentage of your recovery after the case is over. This system works well for a personal injury claim, like yours, because it’s one less thing you have to worry about. Typically, the fee is one-third of the total recovery. Additionally, most firms will advance the costs of litigation, for things like paying for copies of records, consulting experts, obtaining black box information from a wreck, and the many costs of litigating a case through the court system. Those costs are different from fees, and they are paid separately, because if the law firm didn’t advance those costs, you’d have to pay them out-of-pocket. Not everyone knows this, but it’s illegal for a law firm to loan a client money. Advancing the costs for handling the claim and lawsuit, and agreeing to take fees at the end of the case, are the only two ways a lawyer can directly give a client financial support in a personal injury claim.

Some cases, like nursing home negligence and premises liability cases, can be very complex, and take much longer than a typical car wreck claim. Firms may charge a higher fee for those.
