These claims are call qui tam lawsuits and are filed under seal to allow the government to investigate and decide whether to intervene in case. If the government intervenes, a whistleblower may receive up to 25% of any recovery.
The False Claims Act also contain provisions that protects a whistleblower from retaliation by an employer. Damages may include 2x back pay, special damages and attorney’s fees.
