Drunk Driving is a epidemic.  Over ten thousand people die in drunk driving crashes each year. In 2017 alone, two hundred and twenty children under the age of 14 were killed by drunk drivers.

Despite these facts, despite the tragedy of deaths and serious, life-altering injuries caused by drunk drivers, insurance companies still refuse fairly negotiate these claims.

North Carolina law allows private citizens, like you, who have been hurt by drunk drivers, to send a message to those drunks and others like them. But the only way to do that is to force insurance companies to do the right thing.  Sometimes only a jury can accomplish that, by looking at the defendant and saying, “STOP.” They do that by returning verdicts for compensatory damages that are large enough to make the insurance company and the drunk driver realize that dangerous behavior isn’t going to be rewarded, and neither is the insurance company’s behavior of jerking around victims for months or years. Juries also do this by returning verdicts for punitive damages that are large enough that news outlets carry the story, and who other potential drunk drivers that it’s just not worth it.

Under North Carolina law, there are caps on almost every kind of damages in almost every kind of case. One critical exception is that there are NO caps on the amount of punitive damages a jury can impose against a drunk driver. By returning a massive verdict, the jury is doing what the legislature wants them to do.

By standing up for your rights, you’re putting that course of action in motion. Many drunk driving cases eventually settle, once the insurance company hires their own lawyer who explains to them why they need to settle.  But some have to go to trial, and either way, these cases are complex enough that you will nearly always need a lawyer to get you through the process.
