Under federal statute 42 U.S.C. § 1983, private individuals can file a civil lawsuit against a state or municipal government for violations of their constitutional rights. This law also protects you when a state government violates federal statutory rights. The federal government is similarly subject to suit if it violates an individual’s rights, in what is known as a Bivens action.
Like other civil lawsuits, plaintiffs who win can recover for a wide array of actual damages including the cost of medical bills, therapy, lost wages, pain and suffering, and emotional distress. These actions also allow for recovery of punitive damages and attorneys’ fees.
