Virginia Whistleblower Protections
Virginia whistleblowers are afforded powerful protections under state and federal law, protecting them from workplace retaliation when they uncover fraud against the government.
Both the federal False Claims Act and the Virginia Fraud Against Taxpayers Act allow whistleblowers who uncover fraud against the government to bring civil actions to recoup public assets. In addition to whistleblowers’ right to share in any recovery, they may have a personal claim if they were retaliated against by their employer for bringing allegations of fraud to light.
Virginia’s act states that whistleblowers are entitled to “all relief necessary to make [them] whole, if . . . discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against in the terms and conditions of employment because of lawful acts done . . . in furtherance of an action under this article.” Possible remedies include reinstatement and two time the amount of back pay owed. The federal act also provides similar protections.
