Whistleblowers who report fraud against the government must file a claim, know as a qui tam complaint, under the False Claims Act  1) within 6 years of the fraud is committed; or 2) within 3 years after the United States knows or should know of the material facts, whichever is longer, provided it is not more than 10 years after the violation.

In Cochise Consultancy Inc. v. United States, ex rel. Hunt, the Court held that in not-intervened cases the longer period of limitations applies.

However, for retaliation claims under the False Claims Act the statute of limitations is 3 years
